Mark Berkowitz’s practice focuses on all aspects of intellectual property, with an emphasis on patent litigation. He litigates patents covering a wide variety of technologies including consumer electronics, semiconductors, e-commerce, power distribution and medical devices. He has assisted in all phases of patent cases from pre-suit investigations through appeal, including discovery, Markman briefing and dispositive motions.
A registered patent attorney, he also prepares and prosecutes patent applications and Requests for Reexamination before the U.S. Patent and Trademark Office. Mr. Berkowitz counsels clients with respect to a broad range of intellectual property matters and prepares opinions with respect to patentability, freedom-to-practice, infringement and validity.
Prior to attending law school, he worked as an electrical engineer at a global defense firm, gaining experience in circuit design, software development and manufacturing.
As an engineering student, he concentrated in image processing technology, the subject of a recent litigation embroiling all the industry participants that used a well-known image compression standard. Using his background, Mr. Berkowitz was centrally involved in the analysis of the prior art and the development of non- infringement positions.
Another major case involved two of the largest biomedical companies in a patent litigation over diagnostic testing instruments. He focused on a patent at the heart of the dispute and determined that the client’s product did not utilize the complicated statistical algorithm described in the asserted patent.
