Patrick Boland has extensive global experience in all areas of trademarks having served as in-house trademark counsel for leading brands and as a lawyer in private practice advising global companies. This experience encompasses oppositions, cancellations, infringements, passing-off actions, anti-counterfeiting and diversion; the selection and clearance of trademarks; the preparation, filing and prosecution of applications and renewals; licensing; and the acquisition and divestiture of trademark assets.
Thoroughly versed in the priorities and practicalities of global corporations, Mr. Boland was Trademark Counsel for prestige fragrance companies Charles of the Ritz Group Ltd. and Yves St. Laurent Parfums Corporation, as well as consumer brand companies S.C. Johnson and Son, Inc. and Colgate-Palmolive Company. This experience gives him keen insight in understanding and counseling corporate clients and in-house counsel.
His international experience includes the landmark worldwide litigation of Ritz Hotel Limited vs. Charles of the Ritz Group Ltd., a dispute involving litigation in 34 countries over the course of more than five years. That and other global litigation gives Mr. Boland unusually strong substantive knowledge of global trademark laws and practice that helps clients obtain a competitive edge in the global marketplace.
He advises a broad range of companies on manufacturing and international distribution through both bricks-and-mortar outlets as well as through e-commerce platforms. Trademark regimes vary greatly from country-to-country. He and the ARE Trademark Team develop strategies for clients intended to gain the strongest legal position possible to protect and enforce their marks and to stop infringers from exploiting their investments and reputation.
