Oxford University Press recently published an article by Charley Macedo, Christopher Lisiewski and Chandler Sturm in the Journal of Intellectual Property Law & Practice. The article, “
U.S. Supreme Court precludes judicial review of time-bar challenges of U.S. Patent and Trademark Office Patent Trial and Appeal Board institution decisions,” explores Thryv, Inc v Click-to-Call Technologies, LP, in which the U.S. Supreme Court held that, when the Patent Trial and Appeal Board grants a petition for inter partes review and rejects a contention that the petition is time-barred under 35 USC section 315(b), that rejection is not reviewable on appeal.
