Arthrex Inc. v. Smith & Nephew Inc., Judge Kimberly A. Moore, writing for the Federal Circuit in 2019, made a broad pronouncement that administrative patent judges of the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office were “principal officers” of the U.S. and must be nominated by the president with the advice and consent of the Senate under the Appointments Clause of the U.S. Constitution.
