Charley Macedo, Christopher Lisiewski and Chandler Sturm published an Oxford University Press Journal of Intellectual Property Law & Practice article on “U.S. Supreme Court Precludes Judicial Review of Time-Bar Challenges of USPTO PTAB Institution Decisions.”

In the article, the authors explore the implications of the Thryv, Inc v Click-to-Call Technologies, LP decision, in which the U.S. Supreme Court held that when the Patent Trial and Appeal Board of the U.S. Patent and Trademark Office grants a petition for inter partes review and rejects a contention that the petition is time-barred under 35 USC section 315(b), that rejection is not reviewable on appeal.
